In execution of a certain Deed of Trust dated January 29, 2016, in the original principal amount of $166,920.00 recorded in the Clerk’s Office, Circuit Court for Southampton County, Virginia as Instrument No. 160000215 . The undersigned Substitute Trustee will offer for sale at public auction in the front of the Circuit Court building for Southampton County, 22350 Main Street, Courtland, Virginia 23837 on September 12, 2017 , at 2:00 PM, the property described in said Deed of Trust, located at the above address, and more particularly described as follows: First, All that certain lot, tract or parcel of land known, numbered and designated as lot #5, Section II, Gillette Subdivision, in Franklin District, Southampton County, Virginia, as shown on plat made by J.E. Henry, Registered Engineer, dated April, 1966- Scale 1″-100″, which said plat is duly recorded in the Clerk`s Office of the Circuit Court of Southampton County, Virginia in Plat Book 9, page 36, whereon said lot is more particularly bounded and described with reference to said plat as follows: “Beginning at a point, an iron pin, in the eastern boundary of Woodland Drive, in the dividing line between the within described lot and lot #6, running from thence North 34 degrees 00` East 161.18 feet to a point, iron pin, in the western boundary of the Pond as shown on said plat; thence South 20 degrees 01` East 55.38 feet to a point, iron pin; thence South 0, 17` West 82.0 feet to a point, iron pin; thence South 89 degrees 01` 08″ West 169.00 feet to a point, iron pin, in the eastern boundary of Woodland Drive, which is the arc of a curve wit h a radius of 279.27 feet, which curves counterclockwise to the West, an arc distance of 59.27 feet to a point, Iron pin; thence North 5 degrees 00` West 61.0 feet to the iron pin, the point of beginning.” Second, All that certain lot, tract or parcel of land known, numbered and designated as Lot #5, Section B as shown on `Plat Showing Addition to lots 4, 5 and 6 in Section II Gillette Subdivision, Located on Woodland Drive, Near Franklin, Franklin Magisterial District, Southampton Country, Virginia, Scale 1″-50`. June 26, 1976. Survey by B.B. Williams C.L.S.` , copy of which plat is recorded in the Clerk`s Office of the Circuit Court of Southampton County, Virginia in Plat Book 12, page 25, whereon said parcel of land is more particularly bounded and described as follows: “Beginning at a point, iron pin, in the dividing line between lot #6 Section B, and lot #5 Section B, and in line of property of the City of Franklin School Board, running thence along the dividing line between the within described lot #5 Section B and property of said School Board, South 9″ 50` West 73.15 feet to a point, iron pin; thence continuing along said dividing line South 5 degrees 43` East 69.09 feet to a point, iron pin, corner for lot #5 Section Band lot #4 Section B in the line of said School Board property; thence South 89 degrees 01` 08″ West 48.32 feet along the dividing line between lot #4 Section B and lot #5 Section B to a point, iron pin, corner for lot #5 Section B and lot #4 Section B, lot #4 Section A and lot #5 Section A; thence along the dividing line between lot #5 Section B and lot #5 Section A, North 0, 17` East 82.00 feet to a point; thence along said dividing line North 20 degrees 01` West 55.38 feet to a point, iron pin, corner for lot #5 Section A, lot #6 Section A, lot #6 Section B and lot #5 Section B; thence along the dividing line between the within described lot #5 Section B and lot #6 Section B North 84 degrees 00` East 72.84 feet to the iron pin, the Point of beginning.” TERMS OF SALE: ALL CASH. A bidder’s deposit of ten percent (10%) of the sale price or ten percent (10%) of the original principal balance of the subject Deed of Trust, whichever is lower, in the form of cash or certified funds payable to the Substitute Trustee must be present at the time of the sale. The balance of the purchase price will be due within fifteen (15) days of sale, otherwise Purchaser’s deposit may be forfeited to Trustee. Time is of the essence.
