NOTICE OF SUBSTITUTE TRUSTEE’S SALE

WHEREAS, default having been made in the payment of the debts and obligations secured by that certain Deed of Trust dated September 15, 2009, by Wallace Williams to Samuel White, PC, Trustee, for the benefit of Mortgage Electronic Registration Systems, Inc. as nominee for Bank of America, N.A., as same appears of record in the Circuit Court of the County of Southampton, Virginia, in Instrument No.: 090003194, (“Deed of Trust”); and as last transferred to Carrington Mortgage Services, LLC, by assignment recorded on August 8, 2016 in Instrument No.: 160001765 in the Circuit Court of the County of Southampton County, Virginia; and

WHEREAS, said Deed of Trust was last sold, assigned and transferred to Carrington Mortgage Services, LLC, the current holder of the Note (Note Holder); and

WHEREAS, the Note Holder appointed the undersigned, Thomas E. Clements, a resident of Henrico County, Virginia, as Substitute Trustee by Substitution of Trustee as same appears of record in the Circuit Court of the County of Southampton, Virginia, in Instrument No.: 170001026 and

NOW THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable as provided in said Deed of Trust by the Noteholder, and that the undersigned, Thomas E. Clements, Substitute Trustee, or his duly appointed attorneys or agents, by virtue of the power and authority vested in him, will on May 15th, 2017, commencing at 1:00 p.m., at the Southampton Courthouse, located at 22350 Main Street, Courtland, VA 23837, proceed to sell at public outcry to the highest and best bidder for cash, the following described property situated in County of Southampton, Virginia, to wit:

All that certain lot or parcel of land situate in the Town of Franklin in the County of Southampton, Commonwealth of Virginia, and being more particularly described as follows:

 

Being known and designated as Lot No.: 152, on a plat showing Subdivision of Property of P.R. Camp and Others, made by 1942, which is duly recorded in the Clerk’s Office of the Circuit Court of Southampton County, Virginia in Plat Book 4, Page 171, said lot being 50 feet deep and is bounded on the North by Lot 151, on South by Lot 153 and on the East by Stonewall Street, and on the West by Lot 138, all as shown on the aforesaid plat.

 

The improvements thereon being known as No. 214 Stonewall Street, Unit B, Franklin Virginia, 23851.

 

BEING the same property conveyed by deed dated June 27, 2006 from Samuel A. Hall and Margie Davis Hall to Wallace M. Williams and recorded in the Clerk’s Office, Circuit Court, Southampton County on July 7, 2006 at Instrument #060003035.

TERMS: Cash. A bidder’s deposit of up to ten percent (10%) of the bid amount may be required in cash or certified funds at the time of the sale. Additional terms and conditions maybe announced at the sale. Deposit, without interest, is applied to the purchase price at settlement. Closing shall occur at the office of the Substitute Trustee within fifteen (15) days of the date of the sale, at which time the balance of the purchase price will be due and payable in immediately available funds. Upon purchaser’s default, the deposit shall be forfeited and the property shall be resold at the risk and costs of the defaulting purchaser. In the event the Substitute Trustee cannot convey to the purchaser marketable title, in the Substitute Trustee’s sole discretion, the sale may be rescinded and the purchaser’s sole remedy shall be the refund of the deposit.

The property will be sold “AS IS” and will be conveyed, subject to all liens, objections, rights, reservations, leases, covenants, conditions, easements, and restrictions superior to the lien of the deed of trust as they may lawfully affect the property.
