In execution of the Deed of Trust dated August 9, 2006 and recorded in Instrument 060007025, of Isle of Wight County land records, Trustee Services of Virginia, LLC, the appointed Substitute Trustee, will offer for sale at public auction at the front steps of the Circuit Courthouse, Courts Building 17000 Josiah Parker Circle, Isle of Wight County, Virginia on March 29, 2017 at 12:00 PM the property more particularly described in the aforementioned Deed of Trust, located at the above address and briefly identified as follows:
IT BEING the same property conveyed to Roger Edsell Boone and Mary Virginia Rawls Boone, his wife, by deed of Herbert N. Rawls, et ux., dated April 12, 1962, and duly recorded in the aforesaid Clerk’s Office in Deed Book 166, at page 109.
PARCEL TWO: ALL that certain portion of the property of Herbert N. Rawls in Windsor Magisterial District, Isle of Wight County, Virginia, more particularly described as follows to wit:
BEGINNING at a point on the West side of Route No. 613, 100 feet from the southeast corner of the property heretofore conveyed to the grantors herein by Herbert N. Rawls, et ux., which said beginning point is the southwest corner of the property of the grantor herein; thence running N. 54° 15′ W. along the line of the property of the said Herbert N. Rawls, et ux., 32 feet to a point, a corner for this property and other property of the said Herbert W. Rawls, et ux.,thence running in a straight line in a northeasterly direction 118 feet, more or less, to a point, the northeast corner of the property heretofore conveyed to the grantors herein; thence running S. 20° 30′ W., 118 feet, more or less, to the point of beginning; said property hereby conveyed being triangular in shape and reference is hereby made to that certain plat showing property of Herbert N. Rawls, dated February 16, 1962, made by Roy Brinkley, C.L.S., recorded in the Clerk’s Office of the Circuit Court of Isle of Wight County, Virginia, in Deed Book 179, page 16 with the improvements thereon.
IT BEING the same property conveyed to Roger Edsell Boone and Mary Virginia Boone, his wife, by deed of Herbert N. Rawls, et ux., dated June 29, 1965, and duly recorded in the aforesaid Clerk’s Office in Deed Book 179, at page 567.
PARCEL THREE: ALL that certain tract of land lying near the Village of Carrsville, containing about five (5) acres, more or less, with boundaries as follows: On the South by land of Joe Branch, Nancy Daughtrey, Mary Mann, Lispie Richardson, and Gavin Rawls, on the East by the land of Willie Wells and Lonnie Rawls, on the North by land of Mittie A. Rawls and John W. Rawls; on the West by land of J.W. Rawls, J.R.C. Brinkley and Lispie Richardson, all these various and several boundaries are duly and plainly marked by iron post or by chopped trees and may be plainly seen.
IT BEING the same property conveyed to Roger E. Boone and Mary Rawls Boone, Husband and Wife, by deed of Mills E. Godwin, Jr., trustee, dated August 9, 1963, and duly recorded in the aforesaid Clerk’s Office in Deed Book 171, at page 386.
The said Mary Rawls Boone having departed this life on October 10, 1986, there by vesting complete title and interest in said property in Roger Edsell Boone, the surviving spouse, by operation of law.1

The property and improvements will be sold in “as is” physical condition without warranty of any kind.
TERMS OF SALE: A non-refundable bidder’s deposit of $15,500.00 or 10% of the sale price, whichever is less, by cashier’s or certified check required at time of sale, except for the party secured by the Deed of Trust. Risk of loss is on the purchaser from date and time of auction. Balance of the purchase price must be paid by cashier’s check within 14 days from sale date. Except for Virginia Grantor tax, all settlement costs and expenses are purchaser’s responsibility. Taxes are pro-rated to the date of sale. Purchaser is responsible for obtaining possession of the property. If purchaser defaults, deposit may be forfeited and property resold at the risk and cost of the defaulting purchaser who shall be liable for any deficiency in the purchase price and all costs, expenses, and attorney’s fees of both sales. If Trustee does not convey title for any reason, purchaser’s sole remedy is return of deposit without interest. This sale is subject to post-sale audit of the status of the loan secured by the Deed of Trust including but not limited to determining whether prior to sale a forbearance, repayment, or other agreement was entered into, the loan was reinstated or paid off, or whether the property became subject to an automatic stay under the U.S. Bankruptcy Code prior to the sale; in any such event this sale shall be null and void and purchaser’s sole remedy shall be return of deposit without interest. Pursuant to the Federal Fair Debt Collections Practices Act, this law firm is a debt collector attempting to collect a debt and any information obtained will be used for that purpose.
