In execution of a deed of trust dated May 3, 2001, Ernest Leon Knight and Brenda C. Knight, recorded in the Clerk’s Office of the Circuit Court for the County of Southampton, Virginia, as Instrument Number 010001458, the undersigned Substitute Trustees, any one or all of whom may act, will offer for sale at the premises located at 931 Armory Drive, Franklin, Virginia 23851, on February 6, 2015, at 12:00 o’clock noon, property located in the City of Franklin, Southampton County, Virginia, which property is more particularly described as follows:

All that certain tract, parcel or piece of land, with the buildings and improvements thereon, situate in the City of Franklin, Southampton County, Virginia, as shown on a plat entitled ‘Plat Showing Survey of a Portion of Property Owned by Trustees of American Legion Post No. 73, Franklin, Virginia’, Scale 1”=30’, dated October 17, 1977, Survey by E. Stuart Ball & Associate, Ltd., Surveyors-Planners, Portsmouth, Virginia, notes as Parcel A and containing 0.66 acre, which said plat of survey is duly recorded in the Clerk’s Office of the County of Southampton, Virginia, in Map Book 12, Page 107, said parcel of land being more particularly bounded and described as follows:

“BEGINNING at a pin in the southern line of Armory Drive in the dividing line between the property of the Trustees of American Legion Post #73 and that now or formerly J. Vaughan Beale; and from said pin running South 25 degrees 15 minutes 00 seconds East 241.50 feet to a pipe in the northern line of the right of way of Seaboard Coastline Railroad Co., thence South 70 degrees 49 minutes 00’ West along said Railroad right of way a distance of 135.00 feet to a pin in the center of a 15-foot water line easement owned by the City of Franklin; thence North 19 degrees 58 minutes 40 seconds West 226.19 feet to a pin in the southern line of Armory Drive; thence in an easterly direction along the arc of a curve to the left with a radius of 411.97 feet an arc distance of 113.85 feet to the point of beginning.”

This sale is subject to all easements, restrictions, conditions, and reservations of record affecting the title to the property hereinabove described.

TERMS OF SALE: Cash. A bidder’s deposit of up to ten percent (10%) of the successful bid in cash or certified funds may be required. Settlement within thirty days of sale. Additional terms may be announced at the time of sale. The successful bidder will be required to execute a Memorandum of Trustee’s Sale outlining additional terms of sale and settlement which will be available for review prior to the announcement of sale.
