COURTLAND—A lawsuit challenging the Southampton County Board of Supervisors’ decision to rezone 238 acres for a motorcycle and ATV dirt track in Ivor is expected to be heard during a Feb. 15 trial.

The trial has been continued three times since May 10.

In 2008, supervisors agreed to rezone property on New Road owned by Tony Scodes from agricultural to industrial for the track. The supervisors, however, denied issuing Scodes a conditional-use permit, which also was needed to operate the track.

Sixteen plaintiffs sued the county because they want to ensure that Scodes can never operate the track. Rezoning the property back to agricultural would take care of the matter.

The suit was filed against the board on Aug. 27, 2008.
